Black Economic Empowerment

Broad-Based Black Economic Empowerment (B-BBEE) is a constitutionally mandated objective of the South African Government’s transformation strategy. B-BBEE consists of measures and initiatives that are aimed at advancing economic transformation by means of increasing the participation of Black people (being South African citizens who have been racially classified as African, Indian or Coloured) in the economy and the promotion of a more equitable income distribution. The Broad-Based Black Economic Empowerment Act, No. 53 of 2003 (the Act) serves as the legislative framework for the promotion of B-BBEE and provides for the establishment of an implementation framework which is to facilitate the promotion of the objectives of the Act. The Act does not place a legal onus on any private entity to have a particular B-BBEE status level. However, any company wishing to do business in South African must consider and develop its B-BBEE position as an entity that does not have a good B-BBEE rating may be hampered in the conduct of its day-to-day business with Government, organs of state and private sector customers.
